The new ‘Fit note’ which will be called the ’Statement of Fitness for Work’ are expected to replace doctors ‘sick notes’ in April. The new ‘fit note’ will used in England, Scotland and Wales.
The ‘fit note’ will display four courses of action which can be recommended by the GP: phased return to work, amended duties, altered hours and workplace adaptations. Their will also be a ‘comments’ box for use when the GP feels another option is more appropriate. Employers will not be obligated to act on the advice of GP’s but will have to ensure that they comply with the regulations as set out in the Disability Discrimination Act.
GP’s will be able to choose from ‘unfit for work,’ ‘may be fit for some work, taking into account of the following advice.’ The Department for Work and Pensions (DWP) acknowledged that the options listed were ‘not exhaustive’ and may not be suitable for certain health conditions or job roles, but said that a more detailed list would overcomplicate the process of completing the medical statement. The maximum sign off for a sick employee has been reduced from 6 months to 3 months, to encourage the individuals return to work as soon as reasonably possible.
The government intends the ’fit note’ to encourage discussions between doctors and patients, and employees and employers about returning to work.
Employers have been advised to review current practices which may need to be amended to accommodate the new system.
